Melofair Hearing Aids | Warranty | Service Plans | Terms and Conditions

 

Melofair Hearing Aids recommends a trial period of 21 days. This trial period is recommended because medical studies show that your brain requires about three weeks to adjust your hearing sense to new hearing aids. This minimal trial period is not required, and you can return your hearing aids at any time within 30 days from the date you receive the product:

 

Purchase Terms:

By selecting an available option, completing the order form and paying the associated fee, You are making a purchase (“Purchase”). When a Customer makes a purchase, the Customer agrees to abide by the terms of this Agreement and represent and warrant that You as the Customer (i) are at least 18 years of age, (ii) are legally able to enter into this Agreement with Melofair Hearing Aids, and (iii) understand that the hearing aids provided under this Agreement are not intended for use by anyone under age 18. If You as the Customer do not agree with the foregoing, You may not Purchase and must return hearing aid(s) (“Device”) and all associated accessory parts and materials (collectively “Equipment”) to Us. This Agreement is deemed to be received by You as the Customer and is effective on the date on which You Purchase (“Effective Date”) and continues until terminated by either party.



Delivery:

Your order will ship via UPS. In most cases, your order will be delivered within seven (7) to fourteen (14) days. We are not responsible for delays in making delivery or failure to make delivery due to causes beyond our control including, but not limited to, acts of regulations of any governmental authority, fire, work stoppages or slowdowns, accident, flood, war, national emergency, acts of God, public disorder, transportation shortages or delays, and shortages of fuel or materials.



30 Day Free Return Policy

When you purchase a Product (as defined below) from Melofair, the first 30 days are considered as a bona fide hearing aid evaluation for a prospective user, if you are unsatisfied with your purchase from Melofair for any reason, you have 30 days from the date you received the Product to request a full refund. You should return any Product (as defined below) purchased on Melofair in accordance with the terms below, excluding the purchase or renewal of any Melofair paid services, which are subject to our Terms of Use & Conditions. Service would not be qualified for 30 Day Free Return and may provide you Free Trial Period for some certain types of subscription plans.

 

Terms of Use & Conditions

To qualify for a 30 Day Free Trial Refund, all the following conditions must be met:

1- The prospective user has at least followed steps 1 to 4 (all and each of them) described on the Bona Fide Evaluation Period Process.

2.- A Return Merchandise Authorization (RMA) must be requested within 30 days after the date you received the Product.

3.- You must return the Product to Melofair to receive a refund. Returned Product(s) must be in good physical condition (not physically broken or damaged) and perfectly clean. All accessories originally included with your purchase must be included with your return, original packaging, user manuals, Inserts and other printed documents.

4.- The Return Merchandise Authorization (RMA) must be included along with your returned product.

5.- If Customers choose to upgrade to a higher price model, the credit from the original order will be applied to the upgraded exchange order. If you choose to try the upgrade exchange order and go beyond the 30 day free trial period of the first original paid order, your first original paid order that was used as a credit towards the upgrade exchange order will not be refunded.

Additional terms and conditions:

a.- Shipping and handling charges, gift wrap fees, and taxes paid (such as state, customs, or VAT) are not refundable.

b.- You are responsible for and must pay all shipping charges and you assume the risk of loss or damage to the returned Product(s) while in transit back to Melofair.

C.- If you return Product to Melofair Hearing Aids (a) without a Return Merchandise Authorization (RMA) from Melofair or/and (b) without all parts and accessories originally included with your purchase, Melofair retains the right to either refuse acceptance of such return or charge you a restocking fee of 30% of the original price of the Product(s) or the retail value of the missing parts and accessories, whichever is higher.



Refunds:

There is typically a delay between the time your returned package is delivered by the carrier/scanned into our system and the time the contents are verified by our warehouse and your refund is processed. If all return instructions are followed (see “To qualify for a 30 Day Free Trial Refund”) and a refund is due, please expect up to four (4) weeks after your package is delivered to our warehouse to allow us time to receive, inspect, and verify your return and complete your refund request. In most cases, however, your refund will be processed in less time.

IN THE EVENT YOU HAVE NOT RECEIVED YOUR REFUND WITHIN THE TIME FRAME AS INDICATED ABOVE, PLEASE CALL (608) 389-3999 WE WILL QUICKLY RESOLVE ANY ISSUES.

Bona Fide Evaluation Period Process

1.- After the Prospective User purchased a Product, the User must conserve the Order Number as it will be used as an identification number which will link the product to the Prospective User.

2.- Once the Prospective User receives the product, they should call a Melofair Hearing Aid Journey Guide at (608) 389-3999

3.-The Prospective User and the Specialist will review the content of the box, if some part or if some accessory is missing the Specialist will quickly solve the problem for you.

The Specialist will guide the Prospective User on how to assemble and disassemble the Hearing Aid and will also explain how to operate and maintain the device, resolving any question the Prospective User could have.

The Specialist will explain how the brain will have to adjust its hearing sense while using the new hearing aids, the brain will need 21 days to adapt the hearing sense to this new condition, this is called the “Hearing Journey”. So these next few weeks are essential for the Prospective User to determine if the hearing aid is the adequate product for its needs.


By the 2nd week, the Prospective User is adapting to the hearing aids. At this point, Brain and hearing senses are fully adapted to the Hearing aid. The Hearing Journey has ended and the customer can continue to contact us on any questions regarding the hearing aids.

The Specialist will also explain to you about the MeloCare and other Service Plans available.

Customer service advice:

-Hearing Aids are not designed to restore normal hearing and will not prevent or improve a hearing impairment resulting from organic conditions.

-In most cases, the infrequent use of a hearing aid does not permit a user to attain full benefit from it.

-The use of a hearing aid is only part of hearing habilitation and may need to be supplemented by auditory training and instruction in lip reading.

-Do not attempt to use a hearing aid in a method not instructed within the accompanying manual.

-Our hearing aids are not suitable for use by anyone under age 18.

-Keep hearing aids out of reach of infants, children, and pets as it may cause a choking or ingestion hazard.



Service, Repair & Replace After the Evaluation Period:

After your Thirty (30) day evaluation period has expired, the cost of any hearing aids service and/or battery replacement and/or any other replacement parts (including accessories) or repair service becomes a Customer responsibility unless the Product is still under the One Year Limited Manufacturing Warranty and we deem it to be a manufacturer defect in our sole discretion or covered under a product “MeloCare” or any other available “Service Plans” separately provided for sale by Melofair Customer Service.



Cancellations

You can cancel your order before the product is shipped. Your entire order amount will be refunded. You may call us (608) 389-3999. Please cancel within 15 hours of placing the order and before dispatch as we normally dispatch within 24 hours of placing the order.

Once you request the cancellation of item(s) in your order, it will take us a maximum of 1-2 business days to cancel the order and initiate a refund. You will be notified the same way you contacted us.

If the Order Status shows the item(s) in your order as 'Shipped', or if your order has a tracking number assigned, it won't be possible to intercept shipment and you will be requested to either Refuse the package or Return to Sender (RTS). This action will incur a cancellation fee of $49 USD (flat rate) and will be deducted from your refund amount. Your refund will be processed soon after we receive the cancelled items back from the courier.

 

Limited Manufacturing Warranty

1 year starting from the date of purchase

Melofair warrants to the original purchaser that your Melofair-branded device (the "Product") shall be free from defects in materials and workmanship under normal use for a period of one (1) year from the date of purchase. If such a defect arises and a return authorization request is received by Melofair within the applicable Warranty Period, Melofair, at its option and to the extent permitted by law, either

(A) repair the Product at no charge, using new or reconditioned replacement parts or

(B) replace the Product with a New or reconditioned product.

In the event of such a defect, to the extent permitted by law, these are your sole and exclusive remedies. Shipping and handling charges may apply except where prohibited by applicable law. This Limited Manufacturing Warranty is valid only in the jurisdictions where the Products are sold by Melofair itself or through its authorized reseller or agent and is valid to the extent permitted by the applicable laws of such jurisdictions. Any replacement Product will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer, or for any additional period of time that may be required by applicable law.



Advice:

Do not wear hearing aids while sleeping, participating in vigorous exercise, showering/bathing, washing your hair, swimming or engaging in any other activity during which hearing aids may get wet. It is recommended that you do not wear hearing aids during any activity that calls for the use of hearing protection. Due to the radio frequency interference caused by digital cell phones, you may not be able to use any hearing aid with a mobile phone. If, while wearing Device, you experience buzzing or other noises when using your cell phone, we recommend that you refrain from using hearing aids with a mobile phone or other devices that emit radio waves. Avoid using hair care products while wearing hearing aids. Keep hearing aids away from moisture, humidity, dust, direct sunlight and extreme heat. When not in use keep them in their case.

Terms of Service

This Limited Manufacturing Warranty applies only to the original purchaser of the Product that was purchased from an authorized reseller or sales channel and manufactured by or for Melofair that can be identified by an authorized “Melofair” trademark, trade name, or logo affixed to it.



Without limiting the foregoing, the Limited Manufacturing Warranty does not apply to any

(a) Melofair products and services other than the Products,

(b) non-Melofair products, even if included or sold with a Product, including, without limitation, any counterfeit products,

(c) products that are, or Melofair reasonably believes to be stolen,

(d) consumables (such as batteries), or

(e) accessories, even if packaged or sold with the Product or embedded in the Product.

This Limited Manufacturing Warranty does not apply to products with the “Made for Melofair” or “Works with Melofair” logos or “Designed for Melofair accessories”.

This Limited Manufacturing Warranty does not apply to a Product or part of a Product that has been serviced, altered, refurbished, or modified by anyone who is not authorized by Melofair, nor does it apply to any cosmetic damage such as scratches and dents, nor does it apply if the warranty period has expired, nor if the inner warranty label is broken or removed, or the serial number label is missing or unrecognizable.

In addition, this Limited Manufacturing Warranty does not apply to damage or defects caused by
(a) use with non-Melofair products;

(b) accident, abuse, misuse, mishandling, flood, fire, earthquake or other external causes;

(c) normal wear and tear or aging of the Product such as discoloration or stretching; or

(d) operating the Product:

(i) outside the permitted or intended uses described by Melofair,

(ii) not in accordance with instructions provided by Melofair, or

(iii) with improper voltage or power supply.



Disclaimer of Warranty

Warranties Exclusive

If the Melofair product does not operate as warranted above, the customer's sole remedy shall be, at Melofair's option, repair or replacement. The foregoing warranties and remedies are exclusive and are in lieu of all other warranties, expressed or implied, either in fact or by operation of law, statutory or otherwise, including warranties of merchantability and fitness for a particular purpose. Melofair neither assumes nor authorizes any other person to assume for it any other liability in connection with the sale, maintenance or use of Melofair's products.

Melofair shall not be liable under this warranty if its testing and examination discloses that the alleged defect in the product does not exist or was caused by customer's or any third person's misuse, neglect or testing, unauthorized attempts to repair or modify, or any other cause beyond the range of the intended use, or by accident, fire, lightning, or other hazard.



Limitations of Liability

Under no circumstances will Melofair, its service provider or either's affiliates, employees, officers, directors or agents be liable for any consequential, indirect, special, punitive, or incidental damages, whether foreseeable or unforeseeable, (including, but not limited to), claims for personal damage, goodwill, inconvenience, delay, profits, use of money or use of the Melofair products or interruption in use.

Melofair and the service providers entire liability and customer's sole and exclusive remedy for claims related to or arising out of these terms and conditions for any cause and despite the form of action, whether in contract or in tort, statutory or otherwise, including negligence and strict liability, will not exceed the amount of the purchase price paid. This limitation of liability will be effective even if customer has advised Melofair or its service provider of the possibility of any such damages.

These terms and conditions give the customer specific legal rights. Customer may also have other rights that may vary from state to state or from country to country. Customer is advised to consult applicable state or country laws for a full determination of customer's rights. Some states or countries do not allow a limitation on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages for consumer products. In such states or countries, some exclusions or limitations of these terms and conditions may not apply to customer.



Implied warranties

Except to the extent prohibited by applicable law, all implied warranties (including, without limitation, warranties of merchantability and fitness for a particular purpose) shall be limited in duration to the duration of this limited warranty. Some jurisdictions do not allow limitations on the duration of an implied warranty, so the above limitation may not apply to you.



Conciliation, Mediation and Arbitration, Alternative Dispute Resolution:

Melofair believes in using of the Alternative Dispute Resolution System to help avoid the expenses and wasted time associated the normal Litigation System. We value our relationship with every customer, for this reason, in the event of any controversy, claim or dispute between Melofair and any Customer arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation or validity thereof, including the termination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Delaware, in accordance with the laws of the state of Delaware for agreements to be made and to be performed in Delaware. Except as otherwise provided in this agreement, Melofair and you, as the Customer, hereby consent to the resolution by binding arbitration of all claims or controversies for which a federal or state court would be authorized to grant relief. The parties agree, the arbitration shall be administered by jams pursuant to its comprehensive arbitration rules and procedures and an arbitrator shall be selected by the jams. The arbitrator shall be neutral and independent and shall comply with the jams code of ethics. The arbitrator shall issue a written award, setting forth the award and basis therefore. The award shall be final and binding upon the parties. The arbitrator shall have the power to award any type of relief that would be available in a court of competent jurisdiction. In addition, the arbitrator shall have the authority to order any party found to have presented any claim or defense without substantial justification to pay the other party’s attorney’s fees and costs. The award rendered by the arbitrator shall be final and shall not be subject to vacation or modification. Judgment on the award made by the arbitrator may be entered in any court having jurisdiction over the parties. If either party fails to comply with the arbitrator’s award, the injured party may petition the circuit court for enforcement. The parties agree that either party may bring claims against the other only in his/her or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. Further, the parties agree that the arbitrator may not consolidate proceedings of more than one person’s claims, and may not otherwise preside over any form of representative or class proceeding. Representation: each party may be, but need not be, represented by an attorney at any arbitration covered by this agreement. Allocation of fees and costs: the arbitrator may, in the award, allocate all or part of the costs of the arbitration, including the fees of the arbitrator and the reasonable attorneys’ fees of the prevailing party. In the event a party fails to proceed with arbitration, unsuccessfully challenges the arbitrator’s award, or fails to comply with the arbitrator’s award, the other party is entitled to costs of suit, including a reasonable attorney’s fee for having to compel arbitration or defend or enforce the award. Discovery: the parties shall be entitled to engage in reasonable discovery in the form of requests for documents, interrogatories, requests for admission, physical and/or mental examinations and depositions, in order to obtain information necessary to prosecute or defend the claims brought. Any disputes between the parties regarding the nature or scope of discovery shall be resolved by the arbitrator(s) in his or her discretion. Exclusive remedy: for claims covered by this agreement, arbitration is the parties exclusive legal remedy. The arbitrator has exclusive authority to resolve any dispute relating to the applicability or enforceability of this agreement.



Governing Law

This Limited Warranty shall be governed by the laws of the State of Delaware, USA, without giving effect to any conflict of laws principles that may provide the application of the law of another jurisdiction.



IMPORTANT NOTICE:

Melofair Hearing Aids are Class 1 Hearing Aid devices under FDA Regulations per 21 C.F.R. Sec 874.3300. For mild to moderate hearing loss. Not suitable for anyone under 18 years of age. As with all medical issues, please consult a physician prior to use or if you have any questions. Individual results will vary, read all instructions/disclosures before use. IMPORTANT NOTICE FOR PROSPECTIVE HEARING AID USERS

Good health practice requires that a person with a hearing loss have a medical evaluation by a licensed physician (preferably a physician who specializes in diseases of the ear) before purchasing a hearing aid. Licensed physicians who specialize in diseases of the ear are often referred to as otolaryngologists, otologists or otorhinolaryngologists. The purpose of the medical evaluation is to assure that all medically treatable conditions that may affect hearing are identified and treated before the hearing aid is purchased



IMPORTANT MEDICAL INFORMATION:

Melofair advise all prospective hearing aid user to consult promptly with a licensed physician (preferably an ear specialist) before buying a hearing aid if Melofair determines through inquiry, actual observation, or review of any other available information concerning the prospective user, that the prospective user has any of the following conditions:

(i) Visible congenital or traumatic deformity of the ear. (ii) History of active drainage from the ear within the previous 90 days. (iii) History of sudden or rapidly progressive hearing loss within the previous 90 days. (iv) Acute or chronic dizziness. (v) Unilateral hearing loss of sudden or recent onset within the previous 90 days. (vi) Audiometric air-bone gap equal to or greater than 15 decibels at 500 hertz (Hz), 1,000 Hz, and 2,000 Hz. (vii) Visible evidence of significant cerumen accumulation or a foreign body in the ear canal. (viii) Pain or discomfort in the ear.

 

Other Services provided by Melofair Customer Service.

These are not insurance policies but service contracts

-Product Subscription Plan-

 

Plan Description:

Product subscription plans are subscription services allow customers to pay for use of the chosen Melofair products at order with additional profits of (1) a new set of eardome for every 3-month subscription period and (2) a free hearing test for every 12-month subscription period instead of acuqiring full ownership from Melofair Inc. Product subscription plans are offered in 2 types as monthly plans and quarterly plans. Price of different product subscription plans can vary for different product models and plan types. Product subscription plans would be auto renewed if not cancelled by customers actively. Product subscription plans are non-refundable.

 

Ownership & Right to Use:

Product subscription plan only transfer the right to use to customers while Melofair Inc. still keep the ownership of the device. Thus, customers of product subscription plans hold the liablity to keep Melofair device in a good condition for Melofair Inc., not harming Melofair Inc.'s ownership right of the device.

 

Plan Cancellation, Loss, Damage & Compensation:

If the customer wants to cancel the plan, they need to send a written confirmation of their intent to cancel the plan to customer@melofair.com and ship back Melofair the original device, assuming all shipping expenses. The cancellation would be confirmed after Melofair received the original product(s) and made sure the returned product(s) in a good condition. If the customer lose or damage Melofair's device or Melofair does not receive the original device for 10 business days, the customer would be seen as breaching the liability to keep Melofair device in a good condition for Melofair Inc. To compensate for such a breach of Melofair Inc.'s ownership right, customer's subscription plans would not be cancelled immediately and would be auto renewed for 6 month period to compensate the loss of Melofair Inc's ownership right.

 

Free Trial Period & No 30-Day Free Return:

Product subscription plan does not have 30-day free return as Melofair Inc. has provided free trials when customer choose the plan. Instead, product subscription plans would provide 15-day free trial for monthly subscriptions and 30-day free trial for quarterly subscriptions.

-MeloCare Plan-

Plan Description:

MeloCare is a subscription service providing additional protections, which are not covered by the warranty, for Melofair devices. Each MeloCare plan covers one (1) free replacement of a Melofair device in the case of loss/theft or uncovered damages by the warranty during the covered period. Each Melofair device comes with a free 6-month MeloCare plan starting from the date of your purchase of the device. MeloCare Plans are non-refundable.

 

Plan Coverage:

If you want to have your device covered by MeloCare for a more extended period, you can purchase standard MeloCare plans at the time of or after your device purchase. Each standard MeloCare plan covers one (1) year. You can buy unlimited MeloCare plans for multiple devices, but no more than one MeloCare plan can be activated for each device at any time.

 

Use of MeloCare:

In case of damages of your device, you should first submit a warranty claim and we will provide you further guidance to return the device to our repair center. If we find out the damages are not covered by the warranty or out of our repair ability after our review, we would inform you to submit a replacement claim checking the box of “uncovered damages” with the original device purchase receipt. In case of loss/theft of your device, you need to submit a replacement claim checking the box of “loss/theft” with the original device purchase receipt. The warranty of your original device and the remaining coverage time of the MeloCare plan used for the replacement automatically voids upon our approval of your replacement claim. The 6-month free MeloCare would be used first before any of your paid MeloCare plans.

MeloCare cannot be used “partially”. You cannot request replacement for a part of the device (left hearing aid, right hearing aid, charging case, USB cable, ear tips or cleaning tool).

 

Purchase and Activation:

MeloCare is only tied to original devices, and replacement devices do not have the free 6-month MeloCare. You can only purchase MeloCare plans for an original device no later than all tied MeloCare plans (including the free 6-month plan) void. If you have unused MeloCare plans tied to an original device after a replacement claim, a MeloCare plan would be automatically activated upon our approval of the replacement claim.

SERVICE CONTRACT PERIOD, COVERAGE AND TERMS OF SERVICE

These Services are offered by Melofair, accepting any of these Services by completing the order form and paying the associated fee, You are accepting an agreement with Melofair. This agreement describes the terms and conditions of product service contract provided by Melofair and the Service Contract Holder, hereinafter referred to as “Customer”, “You”, or “Your”. The Customer agrees to abide by the terms of this Agreement and represent and warrant that You as the Customer (i) are at least 18 years of age, (ii) are legally able to enter into this Agreement with Melofair, and (iii) understand that the hearing aids Services provided under this Agreement consist in the following:

Plan Description:

MeloCare Annual Plan is a subscription service providing additional protections, which are not covered by the warranty, for Melofair devices. Each MeloCare Annual Plan covers one (1) free replacement of a Melofair device in the case of loss/theft or uncovered damages by the warranty for one (1) year from your purchase date. MeloCare Plans are non-refundable.

 

Plan Coverage:

If you want to have your device covered by MeloCare for a more extended period, you can purchase standard MeloCare plans at the time of or after your device purchase. Each standard MeloCare plan covers one (1) year. You can buy unlimited MeloCare plans for multiple devices, but no more than one MeloCare plan can be activated for each device at any time.

 

Use of MeloCare:

If we find out the damages are not covered by the warranty or out of our repair ability after our review, we would inform you to submit a replacement claim checking the box of “uncovered damages” with the original device purchase receipt. The warranty of your original device and the remaining coverage time of the MeloCare plan used for the replacement automatically voids upon our approval of your replacement claim. The 6-month free MeloCare would be used first before any of your paid MeloCare plans.

MeloCare cannot be used “partially”. You cannot request replacement for a part of the device (left hearing aid, right hearing aid, charging case, USB cable, ear tips or cleaning tool).

 

Purchase and Activation:

MeloCare is only tied to original devices, and replacement devices do not have the free 6-month MeloCare. You can only purchase MeloCare plans for an original device no later than all tied MeloCare plans (including the free 6-month plan) void. If you have unused MeloCare plans tied to an original device after a replacement claim, a MeloCare plan would be automatically activated upon our approval of the replacement claim.

Melofair Inc. reserves all rights regarding MeloCare, including explanation and taking any legal actions. You should not maliciously use MeloCare to claim replacement for illegal purposes or other purposes that would harm Melofair Inc. or its related entities.

 

This Agreement is deemed to be received by You as the Customer and is effective on the date on which You pay the Fee (“Effective Date”) and continues until the one (1) year period has ended or is terminated by either party.

 

Limitations of liability

Under no circumstances will Melofair, its service provider or either's affiliates, employees, officers, directors or agents be liable for any consequential, indirect, special, punitive, or incidental damages, whether foreseeable or unforeseeable, (including, but not limited to), claims for personal damage, goodwill, inconvenience, delay, profits, use of money or use of the Melofair products or interruption in use.

Melofair's and the service provider's entire liability and customer's sole and exclusive remedy for claims related to or arising out of these terms and conditions for any cause and despite the form of action, whether in contract or in tort, statutory or otherwise, including negligence and strict liability, will not exceed the amount of the purchase price paid. This limitation of liability will be effective even if customer has advised Melofair hearing aids or its service provider of the possibility of any such damages.

These terms and conditions gives the customer specific legal rights. Customer may also have other rights that may vary from state to state or from country to country. Customer is advised to consult applicable state or country laws for a full determination of customer's rights. Some states or countries do not allow a limitation on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages for consumer products. In such states or countries, some exclusions or limitations of these terms and conditions may not apply to customer.
